Terms of Service

The service

Pilkix, operated by Pilkix, generates images from the photo or photos you select, using templates that we publish and review. Most templates use one photo; some ask for several, and the template shows how many. You choose a template; you do not write your own instructions to the image model. Each generation spends tokens from your balance.

Your account

You need an account to use Pilkix. You must be at least 18 years old. Pilkix is not directed at, and may not be used by, anyone younger; if we learn that an account belongs to a minor, we delete it. Keep your sign-in credentials to yourself; you are responsible for what happens under your account. You can delete your account at any time — see Delete your Pilkix account.

Tokens and payments

Tokens are bought through Google Play and are consumed when you generate an image. They are not money, cannot be exchanged for money, and cannot be transferred between accounts. Refunds are handled under Google Play's refund policy and under any refund right the law gives you. A failed generation that is our fault does not consume tokens; deleting your account forfeits any unused balance.

What you upload

You keep ownership of the photos you upload. You grant us only the permission we need to store and process them in order to produce the result you asked for, to keep them in your library until their retention period ends or you delete them, and to keep the service safe. That processing may run on our own machines or through Google's image-generation service acting for us, depending on the selected template and available capacity. Google may be the primary route, not only a fallback. Every photo you select for a generation is sent to the processor that runs it. We do not use your photos to train models, we do not permit our providers to, and we do not publish them.

Before generation starts, every photo you select is checked automatically, and the result is checked again before it is delivered to you. If a photo fails its check, the generation stops; if a result fails, it is withheld. These checks do not confirm that you have the right to use a photo or the permission of the people in it, and they cannot guarantee that every harmful image is detected. That responsibility stays with you.

What you generate

You may use the images Pilkix generates for you, including commercially, subject to these Terms. We do not claim ownership of them. Generated images are synthetic: do not present them as photographs of something that actually happened. A result can change facial and other details; it is not guaranteed to be an exact likeness of anyone pictured.

Acceptable use

You must not use Pilkix to:

• upload a photo unless you have the right to use it and the clear permission of every person pictured in it — when a template uses several photos, this applies to each of them — or upload a photo of a child in any template that alters how a person looks;
• produce sexual or nude imagery, or any sexualised depiction of a minor — this is never permitted, under any circumstances, and we report it to the authorities;
• produce intimate or sexualised imagery of a real person without their consent;
• impersonate a real person, or create images intended to deceive, defraud, defame or harass;
• produce content that promotes hatred or violence against people because of who they are, or that depicts graphic violence;
• do anything illegal, or attempt to bypass the limits, safety checks or billing of the service.

SDXL model restrictions

Some Pilkix templates, including Business Portrait, use Stable Diffusion XL Inpainting (SDXL) hosted on Pilkix-operated machines. SDXL is governed by the CreativeML Open RAIL++-M License (July 26, 2023). By using a template that runs SDXL, you agree to the restrictions below and acknowledge that SDXL and its derivatives are subject to section 5 and Attachment A of that license. You must not use SDXL, its derivatives, or an output from it in a way that contravenes those restrictions. You are responsible for the outputs you generate and how you use them. • Use that violates any applicable law or regulation.
• Exploiting, harming, or attempting to exploit or harm a minor.
• Creating or spreading verifiably false information for the purpose of harming others.
• Creating or spreading personal data that could be used to harm an individual.
• Defaming, disparaging, or harassing another person.
• Fully automated decisions that adversely affect a person's legal rights or create or change a binding, enforceable obligation.
• Discriminating against or harming individuals or groups, or providing material for that purpose, based on their online or offline social behaviour or known or predicted personal or personality traits.
• Exploiting vulnerabilities of an individual or group based on age, social, physical, or mental circumstances to materially distort the behaviour of an individual or group, in a way intended to or having the effect of causing physical or psychological harm.
• Discriminating against individuals or groups, or providing material for that purpose, based on legally protected characteristics.
• Providing medical advice or interpreting medical results.
• Creating or spreading material for use in the administration of justice, law enforcement, immigration, or asylum, including profiling people for suspected fraud or crime, drawing causal conclusions from documents, or indiscriminate or arbitrarily targeted use.

Reporting content

If a generated image is offensive or breaks these rules, report it from the app on the result screen. Reports are reviewed by a person. We may remove content, refuse to generate, suspend or terminate an account, and report unlawful material to the authorities.

Availability and liability

Pilkix is provided as it is. We do not promise that a generated image will meet a particular expectation, or that the service will be uninterrupted. Nothing in these Terms limits liability that cannot be limited by law, including for death, personal injury or fraud. Beyond that, our liability to you is limited to the amount you paid us in the twelve months before the claim.

Changes and ending

We may update these Terms; the date at the top changes and material changes are announced in the app. You may stop using Pilkix at any time by deleting your account. We may suspend or end your access if you break these Terms.
